In an unusual development inside the courtroom, a sitting lady judge was directly accused of bias in open court, without any restraint in language. The allegations were presented in detail, including claims about her past associations with the RSS and the BJP-affiliated Advocates’ Council. It was also pointed out that both of her children are empanelled with the central government.
Despite the seriousness of the accusations, the judge continued to preside over the proceedings. Observers noted that, in similar situations, judges often refer the matter to the Chief Justice for reassignment of the case or voluntarily recuse themselves to maintain the appearance of impartiality.
Recusal is not uncommon in higher courts, with judges in High Courts and the Supreme Court frequently stepping aside at their own discretion when questions of bias arise. However, in this instance, even as allegations were made in open court, the judge chose to remain on the bench, raising questions among some about judicial propriety and convention.
