’The Jurisdiction Shield: How Delhi’s Borders Protect Gurugram’s Erring Builders In the complex ecosystem of NCR real estate, a troubling pattern has emerged: while the Haryana Real Estate Regulatory Authority (HARERA) Gurugram bench issues the warrants, the Delhi Police often appear to set the tempo for the dance. This lack of interstate coordination has turned the border into a sanctuary for influential builders, leaving the Adjudicating Officer’s orders effectively toothless.
The Enforcement Loophole.
When the HARERA bailiff, supported by Gurugram Police, attempts to execute an arrest warrant at a builder’s Delhi residence, the process hits a bureaucratic wall. Legal protocol requires the visiting team to seek local assistance from the Delhi Police. However, this “assistance” often acts as a tactical delay:
* The Tipping Point: By the time the Delhi Police grant permission to search the premises, the accused is often alerted. Allegations of “tips” from within the ranks suggest a collaborative effort to ensure the builder is long gone before the bailiff crosses the threshold.
* The Policy Shift: Previously, the Haryana Police were tasked with direct execution. However, following a high-level intervention during former CM Manohar Lal’s tenure, the responsibility was shifted to the Authority’s bailiff, with the police relegated to a “support” role.
The Bailiff’s Dilemma
This shift in policy raises a “million-dollar question” regarding the practicality of enforcement. Most high-profile builders reside in fortified mansions, protected by private security details and guard dogs.
