Subject: Request for intervention for justice in relation to illegal, unethical and inhuman action taken by the officials of the Electricity Department with the minor daughter of an Indian Army soldier and about the police not registering an FIR even after 1 month.
Sir,
It is humbly requested that I am Tasleem Kataria, son of Shri Gaffar, resident of village Kuliaka, Tehsil Sohna, District Gurugram (Haryana). Presently I am working in the Indian Army and am currently posted in Hyderabad.
I am submitting this letter to appeal for justice in relation to a serious and reprehensible incident that happened with my 15-year-old minor daughter “Sahiba” on 01 April 2025.
Description of the incident:
On 01 April 2025, between 4:00 and 4:30 pm, SDO Mukesh Gaur, JE Sohanlal and JE Sumit Garg of Electricity Department arrived at my house in vehicle number HR72 G 5523 without any policeman or woman officer. At that time my wife had gone to her parents’ house and my minor daughter “Sahiba” was alone at home.
These officers forcibly entered the house and:
– violated the principles of Shariat and the Indian Constitution,
– abused, misbehaved and even slapped my daughter,
– and violated the privacy and dignity of a minor Muslim girl.
Legal and Constitutional Context:
1. Article 21 and 25 of the Indian Constitution – violation of life, liberty and religious rights.
2. POSCO Act and sections 354, 448, 504, 506 of IPC – provisions related to women and child protection.
3. Muslim Women (Protection of Rights) Act, 2019 – protection of the dignity of Muslim women.
4. According to Shariat – it is strictly haram for men to go near a minor girl without permission.
Administrative apathy:
– On 01 April 2025, at 11:16 pm, I complained by email to cp.ggn@hry.nic.in.
– On 02 April 2025, an FIR was lodged against my own family.
– On 09 April 2025, I met the Commissioner of Police, Gurugram and DCP South and again applied under complaint number 250336, but no action has been taken till now.
A Jawan’s Question – Call for Justice:
Hon’ble Chief Minister, it is very unfortunate that by ignoring my complaint, the police administration has filed my complaint in the office by taking an affidavit from my opposite party.
In such a situation, I want to ask you how will Indian Army soldiers like us get justice?
We are posted on the border risking our lives to protect the country’s borders, but when our family is not safe at home and our daughters have to face humiliation and neglect instead of justice, then this situation is very sad and worrying.
Previous Background:
It is worth mentioning that on 18 February 2024, a complaint of bribery was lodged against JE Sohanlal and other employees of the Electricity Department, which was related under Memo Number CE-80/ES-41/G-2/40/III. At that time, keeping in mind the departmental honor and social harmony, I had resolved the matter peacefully. But it is clear that the incident of 01 April 2025 was a malicious action taken in retaliation for the earlier complaint, which was carried out by taking undue advantage of my absence and the presence of only a minor girl in the house.
Request:
Being a soldier and a father, I humbly request you that:
1. An impartial investigation should be conducted into this serious incident.
2. An FIR should be lodged immediately against the concerned electricity department officials.
3. The guilty officials should be suspended and legal action should be taken.
4. Information about this incident should be sent to the National Commission for Child Rights, Human Rights Commission and other concerned institutions.
You are requested to cooperate in getting justice for my daughter and direct the administration to take impartial action.
