MDU Rohtak has often hit media headlines for the wrong reasons. One such case, titled “Rules Bent to Allow Migration of Minister’s Son” by Sunit Dhawan, was published in The Tribune.
The authorities of Maharshi Dayanand University (MDU), Rohtak, allowed migration to the son of a state minister in clear violation of university rules and despite refusal by its Academic Council.
The MDU administration permitted Nishit Kataria, son of Haryana Sports Minister Sukhbir Kataria, to migrate from OP Jindal Global University, Sonepat, to the University Institute of Law and Management Studies (UILMS), Gurgaon.
Clause 3 of the MDU Ordinance — Migration to LLB/LLM Course (Calendar Volume 2, Part B, Page No. 83) clearly states:
“In the case of migration from other university, a candidate who has compartment/reappear in any subject will not be eligible.”
According to Nishit Kataria’s application, he had failed in two examinations in the fourth semester, failed in two examinations in the fifth semester, was absent in one examination, and was debarred in one examination at OP Jindal Global University, where he was enrolled in the five-year BA-LLB programme.
Despite this academic record, he was granted migration on medical grounds, overruling the decision of the MDU Academic Council.
MDU Vice-Chancellor H.S. Chahal claimed that the migration was allowed after convincing the members of the Academic Council. However, the university failed to explain how the migration was approved several months prior to the Academic Council meeting, which supposedly gave its consent.
The MDU administration also informed the Academic Council that the Director of UILMS had recommended that students could be migrated to the seventh semester of the LLB course. However, since Nishit had not appeared in the sixth semester examination at OP Jindal Global University, MDU approved his migration in the fifth semester as a “special case,” citing that “he had been failed/debarred in the fifth semester examination.”
The Academic Council subsequently resolved that the request should not be accepted in the form presented. Nevertheless, the university authorities proceeded on the basis of the migration and No Objection Certificates issued by OP Jindal Global University, along with the recommendation of the UILMS Director.
The matter was first placed before the Academic Council in its meeting held in August 2013, and after refusal, it was again discussed in the subsequent meeting held in January 2014.
Nod to Migration
Despite refusal by the Academic Council, the MDU administration approved the migration of Haryana Sports Minister Sukhbir Kataria’s son in the fifth semester as a “special case.” The decision was taken on the basis of migration and no-objection certificates issued by OP Jindal Global University and the recommendation of the UILMS Director.
