Justice K.N.Saikia appointed to probe the circumstances immediately preceding and resulting in the death ,during the night of 16th /17 th May 1990 of Amir Singh candidate in Meham assembly bye-election in its report submitted on May 31,1994”The actions of and circumstances around Mr Chautala and his man resulted in the death of Amir Singh candidate in bye-election of Meham assembly constituency “.Recall that bye-election was necessitated as sitting MLA Devi Lal has resigned the seat after becoming Deputy Prime Minister in union cabinet led by V.P.Singh.
Then CM,Om Parkash Chautala was facing Meham Chobisi supported independent candidate Anand Singh Dangi.Amir Singh was also contesting as an independent candidate and he was found murdered resulting into the countermanding of the election.A case was registered against Anand Singh Dangi in connection with the murder of Amir Singh.Justice Saikia in his report had submitted “Facts relating to the violent incidents in village Madina (native village of Anand Singh Dangi) and the registration of the case FIR at Bawani Khera P.S on 17-5-90; investigation of the case ;formation and sending of investigation and arresting party from Bhiwani to arrest Mr Dangi with the assistance of Meham Police;carrying of the dead body of Amir Singh from Bhiwani Civil Hospital to Madina for cremation and the violent incidents at and near the residence of Mr Dangi in Madina village in the evening of 17-5-90”The evidence on record shows that in the afternoon a large force of about 305 police personnel including a CRPF contingent drawn from the three districts namely Bhiwani ,Rohtak and Sonipat,consisting of all police ranks from constable upwards to a DIG in police buses ,jeeps and cars with the avowed purpose of arresting Dangi stormed into Madina and came to the doorstep of Dangi’s Baithak and demanded surrender and attempted to arrest him; and on being allegedly fired and pelted at ,the police opened fire causing instantaneous death of Dangi’s servant Shri Kishan Chand inside the ground floor of Dangi’s Baithak and of Yashwanti (14 years) near a first floor window inside her house near the street leading to Dangi’s Baithak and a nearby house mortally wounded Bharti -an old lady of 70 years,who died on her way to hospital and also injured several Madina villagers of the locality.
Being unable to stand public resistance without effecting any arrest as ordered by the DIG Rohtak,the police force retreated under the cover of firing of their own in police vehicles to the Canal Rest House Madina “The role of police authorities therein was not in accordance with law observed Justice Saikia.The Commission while arriving at the findings has not been oblivious of the fact that it ought not to weigh the action and decision of the police authorities in the golden scales sitting in the calm and cool atmosphere of the Commission Hall after such a long period of;and due consideration has been given to the situation prevailing at the relevant time imagining itself,as nearly as possible,to be in the circumstances that really prevailed at the relevant time.The Commission as acted ex debito justice.
The Commission has not also accepted the “ golden rule “type of argument for placing themselves in places of persons who have been offended .In course of the proceedings the Commission doubted some amount of synchronisation and planning of evidence.
