Years after the landmark judgment of the Supreme Court of India in the Manesar land scam case, another significant ruling has now come from the court of Dr. Gagan Geet Kaur. The Gurugram ADJ granted bail to a union leader arrested during the April 9 labour unrest in Manesar, clearly observing that demanding higher wages is not a crime.
The report was prominently carried by The Indian Express through journalist Abhimanu Hazarika under the headline:
“Manesar Protests: Demanding higher wages not an offence; Court grants bail to union leader.”
While granting bail, the court reportedly observed that the union leader had been kept in “illegal custody” and that there was “nothing incriminating” against him.
The judge further stated:
“Making a demand to raise wages by the workers before the government is not an offence.”
The ruling is being seen as a strong reminder of workers’ democratic rights and raises serious questions over the conduct of the Manesar Police in handling labour-related protests.
